1. Agreement to Terms

By accessing or using the Nicole Adams website, purchasing our products, or otherwise using our services, you agree to be bound by these Terms of Service.

If you do not agree to these Terms, please do not use our website, products, or services.

2. About Our Products

Nicole Adams sells digital products designed primarily for teachers and educators, including interactive planners, downloadable resources, templates, guides, and other digital files.

All products are delivered electronically. Unless expressly stated otherwise on the product page, no physical item will be shipped.

Certain products may require compatible software, applications, or devices in order to use all available features. Any relevant compatibility requirements or recommendations are described on the applicable product page or accompanying instructions.

3. Purchases and Payment

Prices are displayed in South African rand (ZAR) unless another currency is shown at checkout.

By completing a purchase, you confirm that the information you provide is accurate and that you are authorised to use the selected payment method.

Orders may be refused, cancelled, or refunded where reasonably necessary, including in cases of suspected fraud, payment issues, pricing errors, or misuse of our Services.

4. Digital Downloads and Licence

When you purchase a digital product from Nicole Adams, you receive a personal, non-exclusive, non-transferable licence to use that product.

Products purchased by an individual may be used for that purchaser's own personal and professional educational purposes, including use in their own teaching practice.

Unless expressly stated otherwise, your purchase does not grant a school-wide, institution-wide, team, or multi-user licence.

You may not:

  • resell or redistribute purchased files;

  • share purchased files with other teachers, educators, colleagues, schools, institutions, or third parties;

  • upload the files to shared drives, public websites, marketplaces, file-sharing services, or online repositories where others can access them;

  • sublicense, transfer, or give away purchased products;

  • reproduce or modify the products for resale or redistribution;

  • remove copyright, branding, or proprietary notices for the purpose of redistributing the product.

If multiple educators wish to use a product, each educator must purchase their own licence unless a separate multi-user or institutional licence is expressly offered.

5. Digital Product Delivery

Digital products are normally made available electronically after successful payment.

It is your responsibility to provide a valid email address and maintain access to the email account used when placing your order.

If you experience difficulty accessing or downloading your purchase, please contact us and we will assist you.

6. Refunds

Because our products are digital and are generally made available shortly after purchase, all sales are considered final once access to the digital files has been provided, except where a refund is required by applicable law.

Please review product descriptions, compatibility information, and system requirements before purchasing.

If a file does not open, a feature is not working as described, you have difficulty accessing your purchase, or you believe there is another technical problem with the product, please contact us at info@nicoleadamsedu.com.

We will make reasonable efforts to resolve technical issues, provide instructions, resend files, or offer another appropriate solution.

7. Software and Device Compatibility

Some of our digital products contain interactive features that depend on the software or device used to open them.

For example, features such as automatic dates, dropdown menus, navigation, form fields, or calculations may require a compatible PDF reader.

Where we recommend specific third-party software, such as Adobe Acrobat Reader, that software is provided and controlled by the relevant third party. We do not control its availability, updates, compatibility, or future functionality.

It is your responsibility to review the compatibility information provided before purchasing and to use an appropriate device and software configuration.

8. Learner and Educational Information

Certain educational products may allow you to enter information relating to learners, parents or guardians, classes, marks, schedules, accommodations, support needs, or other education-related information.

You are solely responsible for determining what information is appropriate to enter into your downloaded files and for protecting any personal, confidential, or sensitive information that you choose to store within them.

You are also responsible for using and storing such information in accordance with:

  • the policies of your school, employer, or educational institution;

  • applicable privacy and data protection requirements;

  • any professional or contractual obligations that apply to you.

You should not store sensitive learner information in a manner that is prohibited by your school, employer, institution, or applicable law.

9. Intellectual Property

All content sold, provided, or displayed through Nicole Adams, including but not limited to digital files, planners, templates, text, graphics, illustrations, layouts, designs, branding, and instructional materials, is owned by Nicole Adams or its applicable licensors and is protected by copyright and other applicable intellectual property laws.

Purchasing a product gives you a licence to use the product as described in these Terms. It does not transfer ownership of the intellectual property to you.

Unauthorised copying, reproduction, redistribution, resale, or commercial exploitation of our content is prohibited.

10. Educational Disclaimer

Our products are organisational and educational resources designed to assist teachers and educators.

They are not intended to replace the professional judgement of a teacher, educator, administrator, school, institution, or other qualified professional.

We do not guarantee that use of a particular planner, template, organisational system, or educational resource will produce any specific professional, academic, organisational, or educational result.

You are responsible for determining whether a product is appropriate for your particular teaching environment and requirements.

11. Disclaimer of Warranties

To the fullest extent permitted by applicable law, our products and Services are provided on an "as is" and "as available" basis.

We do not guarantee that our website or digital products will always operate without interruption, error, or compatibility issues, particularly where their operation depends on third-party software, operating systems, devices, browsers, or services.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Nicole Adams will not be liable for indirect, incidental, special, consequential, or similar damages arising out of or relating to your use of, or inability to use, our website, products, or Services.

This may include, without limitation, loss of data, loss of files, loss of productivity, or issues resulting from incompatible software, devices, third-party services, or improper storage of digital files.

You are responsible for maintaining appropriate backup copies of files containing information that is important to you.

Nothing in these Terms limits or excludes liability where doing so would be prohibited by applicable law.

You agree not to:

Purchasing a product does not automatically entitle you to future versions, updates, additional products, or newly released features unless Lifetime Updates or another update entitlement is expressly included with your purchase.
